Monica Kimani’s Death Ruled Homicide

Justice Nzioka, presiding over the Milimani Law Courts in Nairobi, has asserted that Monica Kimani’s demise is undoubtedly a case of homicide. Delivering her remarks on Friday while presenting an analysis of Monica’s cause of death, Justice Nzioka emphasized that the prosecution has effectively demonstrated the unlawful nature of her passing.

The Judge highlighted the reliance on medical examination evidence, notably from Dr. Njenga. During cross-examination by the defense counsel, Dr. Njenga clarified that there were no indications of excusable homicide circumstances. He noted the absence of strangulation, gunshot wounds, and any anomalies in the pancreas. The bleeding from the nostrils, he explained, was due to the throat being slit at the thyroid glands level, a wound unlikely to occur post-mortem due to lack of blood circulation.

Based on Dr. Njenga’s testimony, Justice Nzioka concluded that Monica’s demise wasn’t accidental or natural, affirming it as a clear case of homicide beyond the scope of excusable offenses. Consequently, the court finds that the prosecution successfully established the unlawful nature of her death.

The trial faced adjournments, with Maribe’s advocate, Katwa Kigen, citing her illness during the last postponement. Jowie stands as the primary defendant in Monica’s murder trial, alongside Jacque Maribe, charged in 2018.

Monica’s body was discovered in her Lamuria Gardens Apartment on Kitale Lane, Kilimani, with her throat slashed, hands and feet bound, and mouth taped shut. The trial, ongoing since 2018, saw 35 witnesses called by the prosecution, while the defense opted not to present any. Despite denying knowledge of Monica or involvement in her demise, the evidence presented in court, according to assistant DPP Gikui Gichuki, sufficiently incriminated them.

Given the nature of the murder, authorities suggested it would have required multiple perpetrators to execute.
