MP Claims 2027 Election Predetermined Amid IEBC Recruitment Court Ruling

Kathiani MP Robert Mbui asserts that the recent court decision allowing the recruitment of new Independent Electoral and Boundaries Commission (IEBC) Commissioners has effectively predetermined the outcome of the 2027 election.

He criticizes the ruling by High Court Judge Mugure Thande, arguing that it gives undue advantage to the Kenya Kwanza coalition party. Mbui emphasizes the importance of maintaining separation of powers, suggesting that the court should refrain from making rulings on matters under parliamentary discussion. He highlights a recommendation from the NADCO report advising the selection panel to pause until parliamentary deliberations conclude.

Narok Senator Ledama Ole Kina expresses dissatisfaction with the court’s decision, suggesting an appeal to the Court of Appeal. He believes that the matter is actively being addressed in parliament to ensure fairness and community representation.

The High Court’s ruling, issued on February 1st, directs the immediate commencement of the IEBC selection process. Justice Mugure Thande defends the decision, emphasizing the primacy of constitutional provisions over political considerations. Constitutional experts warn of a constitutional crisis as the IEBC is expected to finalize boundaries delimitation by the end of the month.

ODM party leader Raila Odinga dismisses the High Court ruling, insisting that parliamentary processes, particularly the report by Wandayi and Kalonzo, must first be completed before addressing IEBC matters. He also reiterates concerns about the cost of living.
