Woman Fined Sh100K as Co-Accused Faces Sh50M Penalty in Drug Case

A court in Wamunyu has convicted two women over drug-related offences following an intelligence-driven operation by the National Authority for the Campaign Against Alcohol and Drug Abuse (NACADA) in Mbiuni, Machakos County.

In a ruling delivered on March 26, 2026, the court found that cannabis seized during an April 10, 2025 raid was linked to the two suspects under different circumstances, resulting in separate verdicts.

Court records show that NACADA officers had placed a house in Kabaa under surveillance after receiving reports it was being used to sell cannabis. During the operation, one of the accused was spotted entering the house with a sack, which she placed beside her.

Officers later recovered 20 bundles of unprocessed cannabis weighing 4.115 kilogrammes from the sack. Inside the house, they also found 87 rolls weighing 90 grammes, along with Ksh 4,220 believed to be proceeds from the illegal trade.

The court ruled that the sack belonged to the second accused, while the cannabis rolls inside the house were linked to the first accused.

Although both were initially charged with trafficking, the court found insufficient evidence to sustain that charge against the first accused and instead convicted her of possession.

Citing the case of Timami v Republic, the court noted that large quantities of narcotics can imply trafficking if supported by evidence.

The first accused was fined Ksh 100,000 or face three years in prison, while the second accused received a fine of Ksh 50 million or a 20-year jail term after the court determined that the amount and circumstances pointed to trafficking.

Following the verdict, NACADA CEO Anthony Omerikwa said the case highlights the importance of coordinated enforcement and adherence to due process in securing convictions.
