The court has ordered the detention of the owner of the fatal Embakasi gas plant, along with two NEMA officials, for a period of 21 days to facilitate the ongoing police investigation.
Derrick Kimathi, the proprietor of the gas plant, along with NEMA officials Joseph Makau and Marrian Kioko, will be held at Embakasi Police Station during this period.
David Ong’are, the third suspect, will be detained for 10 days initially, extendable to a maximum of 14 days due to his medical condition. He will be held at Capitol Hill Police Station.
The court received medical documents for Ong’are on Tuesday, although these were not disclosed publicly.
The state had requested the 21-day detention period to complete investigations into charges including murder, conspiracy to commit a felony, negligent acts, and abuse of office.
The legal representatives for the accused, led by Wandugi Kirathe, had requested that they be held at Capitol Hill Police Station, but this request was denied by the State.
Lead prosecutor James Gachoka emphasized that the application for detention had clearly specified Embakasi Police Station as the preferred location for holding the suspects.
