Ten Machakos County Officials Accused of Assaulting MCA During Arrest

Ten Machakos County inspectorate officers allegedly involved in the forceful arrest and assault of Kalama Ward MCA Boniface Maeke on Wednesday have been apprehended and presented in court.

The individuals charged include James Mwendwa Muindi, Albanus Muli Maluki, Joshua Kitolo Mutiso, David Ouma Otieno, Cliff Benson Kimeu, Simon Musembi Ndeto, Bonface Kioko Musyoka, Evans Mwambi Muthenya, Alex Wambua Musembi, and Jeff Musyoki Mutangili.

In a legal application filed by the Machakos DCI on Thursday, the prosecution sought to have the officers accused of robbery with violence, assault, and other charges for causing bodily harm to MCA Maeke.

DCI Kathambi Nancy Mumma, the applicant, also requested the court to detain the county askaris for 14 days at Machakos Police Station pending the completion of investigations.

“The applicant is conducting investigations regarding an offense of robbery with violence, assault causing actual bodily harm, and creating a disturbance likely to cause a breach of peace,” stated the affidavit seen by Citizen Digital.

Mumma expressed concerns that releasing the suspects could impede investigations, especially since some accomplices might still be at large and an identification parade has not yet been conducted.

“The identification parade has not been carried out, witness statements are incomplete, and if the respondents are released, they may interfere with the investigations,” she asserted.

According to Mumma’s account of the attack on the MCA, the suspects allegedly stripped him naked and inflicted injuries to his left ankle, hand, ribs, and private parts. They are also accused of stealing Ksh.100,000 from his wallet and a Samsung mobile phone valued at Ksh.150,000.

MCA Maeke, still recuperating, was unable to attend the court session as he was rushed to Bristol Park Hospital and later transferred to Nairobi Hospital for further medical attention.

The incident, occurring outside the Machakos Law Court, ensued in chaos as a group of men accosted Maeke, who was there in solidarity with Masii MCA Douglas Musyoka following his arrest. Maeke resisted entering county vehicles during the arrest and suffered a broken ankle.

The aftermath of the attack has drawn public condemnation, with Governor Wavinya Ndeti ordering an investigation into the matter.
