Senate Calls for Public Participation on Constitution (Amendment) Bill, 2025

The Senate has invited Kenyans to submit their views on the Constitution of Kenya (Amendment) Bill, 2025, which seeks to strengthen devolution, redefine parliamentary roles, and improve service delivery.

The Bill proposes to elevate the Senate to equal status with the National Assembly by ensuring most legislation is debated and passed by both houses.

It further introduces mechanisms for accountability at both national and county levels, particularly in the allocation and use of public resources. The Bill is sponsored jointly by Senate Majority Leader Aaron Cheruiyot and Minority Leader Stewart Madzayo.

Among its key provisions, the Bill would grant the Senate a direct role in budget-making and in approving top state officers such as the Controller of Budget and the Auditor-General. It also seeks to create a constitutionally protected County Assembly Fund to safeguard the financial independence of county legislatures.

Currently, the Constitution restricts the Senate from initiating or handling money bills—a role reserved for the National Assembly—leaving senators with limited input on financial legislation.

If adopted, the amendment would expand the Senate’s veto powers, give it a formal role in approving the national budget, and empower it to oversee the vetting of senior state officials, including Cabinet Secretaries.
