The Ethics and Anti-Corruption Commission (EACC) has successfully reclaimed public land worth Sh30 million in Nyali, Mombasa, after a 12-year court battle.
The 0.13-hectare parcel, which had been grabbed despite being set aside for the expansion of Links Road near 1st Avenue, has now been returned for public use.

In a ruling delivered on October 22, 2025, Justice S.M. Kibunja of the Mombasa Environment and Land Court declared that the title issued to the late Sheikh Ali Taib was illegal and ordered its cancellation.
The court further directed the Mombasa Land Registrar to amend the land register and restore the property to public ownership.
Investigations revealed that the land was irregularly allocated in 1996 by the then Commissioner of Lands and subsequently transferred through multiple parties before ending up with Sheikh Ali Taib.
EACC filed the recovery case in 2013 against the involved parties, including the former Commissioner of Lands, seeking to nullify the illegal allocation.

Justice Kibunja also issued a permanent injunction barring the defendants from selling, transferring, or occupying the land, except by surrendering it to the government.
EACC welcomed the ruling, saying it underscores its continued commitment to reclaiming grabbed public land and protecting national assets for public benefit.
