Senator Omtatah’s Bid to Stop Roll out of SHIF Flops

The High Court has declined to suspend the roll out of the Social Health Insurance Fund.

The court directed that the case filed by Busia Senator Okiya Omtatah and two others be heard on a priority basis.

Justice Bahati Mwamuye certified the matter as urgent and directed the petitioners to serve the application on the Health CS and other parties immediately.

 

The respondents are to file their responses by close of business October 4.

The matter will be mentioned on October 9 to take a priority hearing date for the application.

 

Omtatah, Eliud Matindi and Dr Magare Gikenyi filed the case on Monday challenging the new health fund.

 

The three argued that the subsidiary legislation required to operationalize the Social Health Insurance Act were not in place.

 

They also took issue with procurement of safaricom consortium to provide and integrated healthcare information technology system.

 

Based on that, they want court to issue an order suspending any contract signed between the government, through the ministry of health and Safaricom Consortium for the provision of integrated Healthcare Information Technology System for Universal healthcare.

The contract is for a sum of Sh104 billion.
