Sarah Wairimu Denied Bail in Tob Cohen Murder Case

The Kibera High Court has rejected Sarah Wairimu’s latest bail application, citing serious concerns over possible witness intimidation, risk of fleeing, and tampering with the crime scene.

Delivering the ruling, Lady Justice Diana Kavedza said there was credible evidence suggesting Wairimu could interfere with witnesses. The court pointed to an incident where she allegedly threatened a police officer in open court.

“If the accused can intimidate an armed officer in front of the court, what might she do when unsupervised?” the judge questioned.

Justice Kavedza stressed that Wairimu must first demonstrate genuine remorse before any future bail request can be considered.

A previous attempt to seek bond relief had also been denied on similar grounds. The court now requires that any renewed bail application be accompanied by an affidavit in which Wairimu pledges not to contact or intimidate witnesses.

The judge underscored that protecting witnesses is crucial to the credibility of the judicial process. “Witnesses are central to a fair trial,” she said. “Any attempt to influence them erodes the foundation of justice.”

The prosecution, led by Vincent Monda, presented fresh evidence suggesting Wairimu is a flight risk. Despite her initial passport being held by police, Wairimu allegedly obtained and used a second passport. Her claim that the DCI coerced her into acquiring it was dismissed as unsubstantiated.

“The fact that she could acquire another passport raises the risk of her fleeing,” the judge said. “What would stop her from getting a third one if released?”

The court also found Wairimu had tampered with the crime scene, having undertaken renovations on a property central to the case.

“Preserving the crime scene is essential, and the accused’s actions compromised that,” Justice Kavedza noted.

The judge ruled that the public interest and need for justice outweighed Wairimu’s personal liberty at this stage. She will remain in custody at Lang’ata Women’s Prison until the trial concludes.

The case will be mentioned again on July 30, 2025.
