The Independent Policing Oversight Authority (IPOA) has refuted reports suggesting that Deputy Inspector General (DIG) Eliud Lagat has been cleared in connection with the death of a suspect, Ojwang, who died in police custody.

IPOA Chairperson Ahmed Issack Hassan labeled the claims as inaccurate and misleading, stressing that investigations into Ojwang’s June 8, 2025, death are still ongoing.
“In line with our earlier statements, IPOA initiated an investigation into the death of Ojwang while in police custody,” said Hassan. “Some suspects have already been taken to court based on preliminary findings, but the case remains active.”
He added that if the evidence eventually implicates DIG Lagat, the authority will not hesitate to recommend accountability measures. “Should the investigation find him culpable, IPOA will take the necessary action,” Hassan said.
The Authority assured the public of its commitment to ensuring justice in all cases involving deaths in police custody and urged patience as the process continues.
Lagat, who is named as a complainant in the case, is currently facing a legal challenge filed by activist Eliud Matindi, who is seeking to bar him from resuming his duties.
On Thursday, High Court Judge Chacha Mwita declined to grant interim orders preventing Lagat from returning to office. Instead, the judge directed him to file a formal response to the petition by July 23, when the case will proceed for further directions.

Matindi’s petition, which was heard on July 14, 2025, seeks to block Lagat from exercising the powers of his office, though the specific grounds of the challenge remain undisclosed as the matter is still under judicial consideration.
