Gachagua: My Brother’s Estate Was Distributed as Per his Will

Former Deputy President Rigathi Gachagua has spoken out on a family succession issue involving the estate of his late brother, Nderitu Gachagua, stating that the process followed the provisions of the deceased’s will.

In an interview, Gachagua noted that inheritance matters are handled by the courts, urging anyone with concerns to seek legal redress through the proper channels.

He explained that the dispute centres on his brother’s estate, following his death in 2017, and that he had left behind a comprehensive will outlining how his assets should be shared.

According to Gachagua, the will clearly listed all beneficiaries and their respective portions, ensuring inclusivity among those linked to the deceased.

He said the estate was divided among 21 beneficiaries, with instructions that assets be sold, liabilities cleared, and the remaining funds distributed based on set percentages.

“Some beneficiaries were allocated 10 per cent, others 5 per cent, and others smaller shares, all detailed in the will,” he said.

Gachagua added that three executors — including the deceased’s lawyer, a close associate, and a family member — were appointed to oversee the implementation in line with the will.

He noted that beneficiaries agreed to the will after it was read, and the court subsequently approved it, allowing the executors to proceed.

The former Deputy President said the process was concluded about eight years ago, with assets sold, debts paid, and proceeds disbursed directly to beneficiaries.

He maintained that the exercise was conducted lawfully and transparently, emphasizing that any disagreements should be resolved in court rather than through public or political avenues.

However, the family of the late James Nderitu Gachagua has since called on the government to step in over concerns regarding the management of the estate.

In a statement dated March 27, 2026, the family said they opted to go public after attempts to resolve the matter privately were unsuccessful.
