Court Halts Plans to Build Church at State House

The High Court has temporarily stopped President William Ruto’s government from constructing a permanent church within the State House grounds in Nairobi or at any State Lodge across the country.

In a ruling on Tuesday, Justice E.C. Mwita issued a conservatory order barring the project until November 18, 2025, when a petition challenging the initiative will be heard.

The case was filed by Transparency International Kenya, the Kenya Human Rights Commission, and two others against the Katiba Institute and the State Law Office. The petitioners argue that putting up a religious facility inside State House undermines the constitutional principle of separating religion from the State.

Justice Mwita said the matter raises weighty constitutional and legal issues that warrant urgent court scrutiny.

“I am satisfied that the petition raises serious questions regarding State and religion that must be thoroughly examined,” the judge noted.

The court directed that all parties be served with pleadings immediately, with responses expected within seven days. Petitioners and respondents will each have an additional week to file supplementary submissions ahead of the mention date.

The case will be mentioned on November 18, 2025, for submission highlights.

The court also attached a penal notice warning that any defiance of the order would attract legal consequences.
