High Court Upholds Westgate Mall Attack Jail Terms

The High Court affirmed the prison sentences for the individuals involved in the Westgate mall attack.

The Milimani High Court, led by Lady Justice Grace Nzioka, upheld the convictions of two suspects linked to the 2013 terrorist incident at Westgate Mall, which claimed 67 lives and injured over 200 others.

During the ruling, Justice Nzioka emphasized that the evidence presented against Mohamed Ahmed Abdi and Hussein Hassan Mustafah, as evaluated during the trial, adequately supported their charges of conspiring to commit a terrorist act.

Justice Nzioka also maintained Abdi’s guilt in possessing an item connected to a terrorism offense, although she cleared both individuals of charges related to supporting a terrorist group.

“The Trial Court, based on testimony from 46 prosecution witnesses, sentenced the two defendants to 18 years each for conspiracy to commit a terrorist act, with the first defendant receiving an additional 15 years for possessing an article associated with terrorism,” stated the Office of the Directorate of Public Prosecutions (ODPP) in a release on Saturday.

“Lady Justice Nzioka upheld the sentencing and the Trial Court’s decision that the sentences should be served consecutively.”

The ODPP expressed gratitude to the Anti-Terrorism Police Unit Officers (ATPU) and prosecutors whose efforts were pivotal in ensuring justice prevailed in this case.
