Omtatah in Court to Halt CAS Appointment Plans

Senator Okiya Omtatah, along with three other individuals, has taken legal action to halt the appointment of Cabinet Administrative Secretaries (CAS) in Kenya.

Omtatah, alongside activist Magare Gikenyi, has filed a lawsuit against the government, arguing that the creation of the CAS office and the Head of Public Service position was done in violation of the law and should be discontinued.

They contend that the government is attempting to amend the law in their favor to facilitate the appointment of CASs, despite ongoing legal proceedings in the Court of Appeal challenging the appointments.

The defendants in the case include the Attorney General, the Public Service Commission (PSC), and the Salaries Remuneration Commission (SRC).

The proposed gross salary for CASs, if appointed by President William Ruto, is set at Ksh. 780,000. This recommendation was made by the SRC to the PSC in April, slightly exceeding the Ksh. 710,000 monthly salary of Members of Parliament (MPs).

The recommended salary includes Ksh. 459,113 in basic pay, Ksh. 165,000 in house allowance, and Ksh. 155,887 in salary market adjustment.

This decision to establish CAS positions came after the National Assembly passed a bill, despite public debate on the government’s significant outstanding bills.

Initially, the Justice and Legal Affairs Committee had limited the number of CASs to 22, but this was later changed to give the president more discretion in their appointment.
