Court Rejects Wa Iria’s Bid to Halt Ksh.562M Graft Case

The High Court has dismissed a request made by former Murang’a Governor Mwangi Wa Iria to halt proceedings in a corruption case involving Ksh.562 million.

Represented by Advocate Ndegwa Njiru, Wa Iria sought to pause the trial pending the resolution of his challenge against the case.

However, Justice Nixon Sifuna ruled that alterations made to the submitted documents without court approval violated legal protocols.

In his ruling, Justice Sifuna emphasized the need for adherence to legal procedures, stating that any actions taken in the name of the law must comply with legal standards. Consequently, the court rejected the application, instructing Wa Iria’s legal team to submit a fresh application, as amending the petition without court permission was deemed improper.

Furthermore, Justice Sifuna highlighted that Wa Iria’s oral request for a stay of proceedings in the related criminal case required a formal application process, including responses from all parties and thorough deliberation by the court.

The court ordered the submission and service of the fresh petition within seven days, along with affidavits confirming the service.

The case is scheduled for mention on May 15, 2024, to monitor compliance with the court’s directives and to provide further instructions on responses and the trial proceedings.

Wa Iria, along with his wife and others, faces multiple corruption charges, including abuse of office, conflict of interest, unlawful acquisition of public property, and money laundering, all of which he has pleaded not guilty to.
