The accused, Fredrick Ojwang, committed the offence on the night of March 28, 2024, at around 10 p.m. in Matofali village, Rongo Sub-County.

He was found guilty and sentenced by Principal Magistrate Susan Mutava, who handed down 10 years for rape and an additional five years for assault causing bodily harm.

“The prosecution has proven its case beyond reasonable doubt based on the evidence presented, in line with legal principles and precedent,” the court ruled. “The accused is therefore convicted of both rape and assault causing actual bodily harm.”

During the trial, four witnesses were called by the prosecution. One of them testified that on the night of the incident, around 11 p.m., he saw a boda boda parked near a bush in the Matofali area.

Upon approaching, he heard a woman crying out for help and found two people on the ground.

The Magistrate commended the victim for her clarity and consistency while giving testimony. Medical evidence submitted in court confirmed sexual penetration, further supporting the prosecution’s case.
