High Court judge Lawrence Mugambi has thrown out a case filed by Eldoret-based singer William Getumbe, famous for his controversial song ‘Yesu Ninyandue’.
Getumbe had sought over Ksh. 243,000 in compensation from the Kenya Film Classification Board (KFCB) after the board banned his song.
The KFCB banned the song in February of the previous year, stating that it was blasphemous and had the potential to offend religious sensitivities.
The board also ordered Getumbe to remove the song and other similar content from his online platforms, warning of legal consequences under the Films and Stage Plays Act Cap 222 if he failed to comply.
Along with Getumbe’s song, another by Kisii-based artist Chris Embarambamba, titled “Niko Uchi,” was also banned. Both songs were criticized for their supposed gospel themes, which the KFCB claimed ridiculed the Christian faith.
