MP Kaguchia: Night in Police Cell Has Strengthened Our Resolve

Mukurwe-ini MP John Kaguchia remained defiant on Tuesday morning after spending the night in police custody following his arrest the day before.

Taking to social media, Kaguchia greeted Kenyans and said his time in detention had only reinforced his determination to pursue justice, insisting it would not deter him from continuing his political work.

“A night in the police cell has only strengthened our resolve and commitment to justice,” he wrote, adding that he intended to keep pushing forward.

The MP also indicated he was scheduled to appear at the Milimani Law Courts for arraignment by 8:30 am that day.

Kaguchia was arrested on Monday and initially taken to the Directorate of Criminal Investigations (DCI) headquarters before being moved to Kamukunji Police Station, where he spent the night.

His legal team said they had not been formally informed of the specific grounds for his arrest, and raised concerns over the confiscation of his phone as well as what they described as restricted access to him following his detention. By Tuesday morning, authorities had not publicly disclosed the charges he could potentially face.

Kaguchia had spent Monday night at Royal Media Services premises after appearing for a television interview, reportedly remaining at the media house out of fear that detectives were waiting to arrest him over remarks he allegedly made regarding political matters.

His arrest sparked swift political backlash, with several leaders accusing the government of applying the law selectively. Critics argued that certain politicians appeared to be targeted based on their political stance, calling for law enforcement to treat all Kenyans equally regardless of political affiliation.

Demonstrations were also reported in parts of Mukurwe-ini Constituency, where Kaguchia’s supporters demanded his immediate release, adding to the mounting political pressure surrounding his detention. Supporters maintained that the arrest was politically motivated.

Former Deputy President Rigathi Gachagua also commented on the matter, arguing that Kaguchia’s arrest would only boost his political standing and turn him into a political hero. Gachagua later stated that the High Court had ordered Kaguchia’s immediate release from custody upon payment of a Sh100,000 police cash bail.

In a statement, Gachagua claimed that officers at Kamukunji Police Station were being misled into disregarding the court order, despite it having already been formally served. He urged the officers to comply with the directive, warning that they risked being held personally liable for contempt of court should they continue holding the MP. He reiterated that the order had been delivered to officers at the station and called on them to act accordingly.

Gachagua’s intervention is likely to further raise the political profile of the case as Kaguchia awaits the next phase of the legal process.
