Liquid Telecom Fined Sh700,000 for Violating data Privacy Laws

The Office of the Data Protection Commissioner (ODPC) has ordered Liquid Telecommunications Kenya Ltd to pay Sh700,000 to a complainant for unlawfully handling personal data without consent — one of the latest penalties under Kenya’s Data Protection Act, 2019.

In its ruling, the ODPC found that the company had collected and processed the personal data of complainant Andrew Alston without his authorization and ignored his legal right to have the information deleted.

Data Commissioner Immaculate Kassait stated that Liquid Telecom violated the complainant’s right to be informed about the use of his personal data as stipulated in Section 26(a) and his right to erasure under Section 40(1)(b) of the Act.

The regulator further noted that even after Alston requested the deletion of his data, the company continued to process it for over a year — a delay described as “unreasonable” and a clear breach of lawful and fair data processing principles.

Consequently, the ODPC directed Liquid Telecom to compensate the complainant Sh700,000 and issued an Enforcement Notice compelling the firm to comply fully with Kenya’s data protection requirements.

“Having determined that the Respondent processed personal data without a lawful basis, this Office orders compensation and enforcement to ensure full compliance,” the ruling stated.
