Hearing on Gachagua Impeachment Case Delayed Awaiting CJ’s Directions

The hearing of the petition contesting the impeachment of former Deputy President Rigathi Gachagua has been postponed, pending new instructions from Chief Justice Martha Koome, who is expected to appoint a new bench.

The case was initially set for mention on Thursday but was adjourned following a Court of Appeal ruling.

A three-judge panel led by Justice Erick Ogolla had been handling the matter. However, in a notice from Assistant Deputy Registrar Hon. Beja Nduke, all parties were informed that the hearing had been deferred.

“Please note that following the Court of Appeal ruling on May 9, 2025, in Civil Appeal No. E829 of 2024, this matter, which was scheduled for mention on May 15, 2025, is adjourned awaiting further directions from the Honourable Chief Justice,” the notice stated.

Further communication will be issued to the parties once the Chief Justice provides formal directions, including the appointment of a new bench to preside over the case.

Last week, the Court of Appeal nullified Deputy Chief Justice Philomena Mwilu’s October 18, 2024, decision to form a three-judge bench for the case. The appellate court ruled that only the Chief Justice has the constitutional mandate to empanel such a bench.

Justice Mwilu’s previous appointment of Justices Eric Ogolla, Anthony Mrima, and Freda Mugambi was challenged by Gachagua’s legal team, which argued it violated constitutional provisions.
