The High Court has temporarily halted the implementation of the Cooperation Framework on Health between Kenya and the United States, signed on 4 December 2025, citing concerns over data privacy.

Justice Lawrence Mugambi ruled that, until a full hearing is conducted, the respondents are barred from operationalizing or enforcing any part of the agreement that involves the transfer, sharing, or disclosure of medical, epidemiological, or other sensitive personal health data.
The court order states:
“Pending the inter partes hearing and determination of the Petitioner’s Notice of Motion dated 9 December 2025, a conservatory order is hereby issued suspending, staying, and restraining the respondents… from implementing, operationalising, or otherwise giving effect to the Health Cooperation Framework… insofar as it provides for or facilitates the transfer, sharing, or dissemination of medical, epidemiological, or sensitive personal health data.”
The directive follows a case filed by Senator Okiya Omtatah, who petitioned the court to stop the rollout of the framework over fears that it could compromise Kenyans’ sensitive health information.

Omtatah also sought to prevent the government from using public funds, signing contracts, or enforcing any policies under the agreement. The High Court granted these measures on an interim basis as the matter awaits a full hearing.
