The High Court has refused to revoke orders demanding the personal appearance of IG Douglas Kanja and DCI Director Mohamed Amin in court regarding the alleged abduction and disappearance of three men in Mlolongo last year.

Justice Chacha Mwita explained that the January order was meant to uphold the constitution and protect the Bill of Rights.
“Ensuring the safety of the three missing individuals remains the court’s priority. It would not serve the public interest to grant the IG and DCI’s request,” Mwita stated.
Kanja and Amin had sought to have the January 8 and January 13 orders overturned, which required them to bring the missing men to court and appear in person themselves.
They later claimed they had not been properly served with the orders and that the court had acted without hearing their side. This was their justification for seeking to overturn the orders.
However, in his ruling, Justice Mwita stated he was convinced the email used to serve the IG and DCI was indeed their correct email address.
“I am therefore satisfied that they were served with the application and the issued orders,” he concluded.
