The Director of Public Prosecutions (DPP) has decided to charge politician Rose Mbithe Ndeti and her two children with the murder of psychiatrist Dr Victoria Nthunya Mutiso.
The DPP informed the court on Monday that a murder case had been registered at the Nairobi High Court against Mbithe and her children, advocates Chris Mulwa and Angela Mulwa.

There was drama at Milimani Law Courts on Monday when lawyer Angela Mulwa was re-arrested outside the courts after Senior Resident Magistrate for Milimani Law Courts, Joan Mati, approved an application filed by the DPP.
This development comes just days after the High Court granted Angela and her co-accused a cash bond of Sh1 million each, allowing them temporary freedom following their arraignment over allegations of possessing a stolen Range Rover Sport worth Sh15 million.
Angela’s defence team, led by city lawyer Danstan Omari, had earlier resisted the State’s attempt to transfer the case to another court, arguing that it should remain before the current judicial officer. Omari pointed out that his client had already appeared before the court and was out on bond, questioning why the case needed to be moved, and warning that such a transfer could interfere with her ability to represent clients in a related matter.
Omari also urged the State to present a properly drafted charge sheet the following day, noting that although the court had granted investigators 21 days to complete their probe, that period had lapsed without substantive evidence being tabled. He argued that the case involved two separate files and objected strongly to the transfer application, insisting the matter should not be moved before the court had properly reviewed the evidence presented.
The prosecution, led by Deputy Director of Public Prosecutions Jalson Makori, said the decision to charge the trio followed the conclusion of preliminary investigations conducted by the Directorate of Criminal Investigations (DCI) into Dr Mutiso’s death. Following the decision, the DPP withdrew an earlier application seeking additional time to detain Angela Mulwa pending further investigations.
Mbithe and Chris Mulwa have also remained in custody while assisting investigators with the ongoing probe.
Dr Mutiso, a psychiatrist and former Director of the Africa Institute of Mental and Brain Health, was fatally shot in Nairobi on July 29, 2026. The court heard that preliminary investigations linked her death to a land dispute that was pending before a court in Machakos.
Prior to her killing, Dr Mutiso had reported an earlier incident in which two armed individuals on a motorcycle allegedly confronted her while she was driving in Nairobi, pointing a firearm at her before she managed to escape. She later reported the matter at Kilimani Police Station.
The DPP said the decision to charge the three suspects was based on evidence gathered during investigations linking them to the alleged crime. A pistol allegedly used in the attack, along with a motorcycle and a car, were recovered during ongoing operations. Police have connected the murder to a longstanding land dispute in the Mlolongo area.
According to the DCI, the killing was carried out with military-style precision, prompting an equally rigorous investigative response grounded in forensic science, intelligence gathering, digital evidence, and inter-agency collaboration.
Among the most significant developments in the case is the alleged involvement of serving police officers in the murder plot. Investigators said evidence obtained during the interrogation of a boda boda rider and a driver led them to officers attached to police posts under Kikuyu Police Station.
The DCI identified Inspector of Police Kenneth Kipkemboi Sang, Officer-in-Charge of Nderi Police Post in Kikuyu, as the alleged link between the financiers and the operational team, further alleging that he supplied the murder weapon. Sang remains at large.
The DCI also announced the arrest of Police Constable Elijah Kibelion Kimoi, attached to Karinde Police Post, whom investigators have identified as the alleged shooter. Another officer, Constable Bett Kiplangat Collins of Thogoto Police Post, has reportedly been forensically placed at the crime scene and is also being sought by detectives.
Police described the alleged involvement of officers as a serious betrayal of public trust, vowing that the Directorate would pursue all suspects regardless of rank or position.
Investigators further revealed they are pursuing additional leads suggesting some suspects linked to Dr Mutiso’s murder may also be connected to the drive-by shooting of lawyer Kyalo Mbobu, which occurred on September 9, 2025, along Magadi Road.
The investigation remains active, with several other individuals — potentially acting as surveillance operatives, facilitators, weapon suppliers, or coordinators — still being pursued.
