Individuals challenging the exorbitant cost of living have submitted a petition to Chief Justice Martha Koome, urging prompt consideration of their case.
The letter outlines five key concerns, including questioning the constitutionality of the Affordable Housing Bill 2023 and the forced eviction of Kenyans from their residences.
Despite their request for urgent certification, Justice Chacha Mwita, in a decision, deemed the matter lacking in urgency. The petitioners were instructed to file and serve the petition, presenting their arguments by June 17, 2024.
The letter expresses discontent, stating, “Despite the fact that in prayer 8 of the notice of motion, the petition seeks certification of the petition from hearing by a five-judge bench, the duty judge prematurely usurped the mandate to fix the petition for hearing by himself.”
Through their legal representative, Kibe Mungai, the petitioners contend that unless the Notice of Motion is expedited and the petition is heard and resolved promptly, it risks losing its relevance by June 2024.
