Controversial Housing Levy Continues in January as Court of Appeal Extends Collection Amid Ongoing Legal Challenge


In January, both employees and employers will continue to bear the controversial housing levy costs. This decision comes in the wake of the Court of Appeal’s directive to maintain the existing situation until the ruling is issued on January 26th.

Judges Lydia Achode, John Mativo, and Mwaniki Gachoka prolonged the conservatory order, permitting the government to persist in collecting the housing tax for this month, responding to the government’s appeal challenging the High Court’s initial order.

According to court documents, the consolidated applications related to the High Court’s judgment on November 28, 2023, will be addressed collectively, with a ruling expected on January 26, 2024. The court emphasized that the prevailing conditions as of today will persist until the ruling is delivered, extending the original expiration date of the conservatory order from January 10th.
