Lawyer Njeri Maina has confirmed that she will challenge the High Court ruling on former Deputy President Rigathi Gachagua’s impeachment at the Court of Appeal, stating that the matter was centered on constitutional principles rather than financial compensation.
Maina said she was dissatisfied with parts of the judgment and emphasized that the legal team would proceed with the appeal process, insisting that the case had broader implications for constitutional interpretation and the rule of law.

“We cannot allow this to pass. Future proceedings will be guided by such judgments,” she said, indicating readiness for the next legal phase.
Her remarks followed a High Court decision that upheld Gachagua’s impeachment but awarded him Sh50 million in damages after finding that his rights were violated when the Senate declined a request for adjournment by his legal team.
However, Maina dismissed any interpretation of the award as a victory, saying the case was not about monetary gain.
“We are not here for the money. It is about the integrity of the Constitution and the processes of our institutions,” she said, adding that the team’s focus was on justice and constitutional accountability.
She further noted that Gachagua followed the court proceedings from home with his family, while his legal representatives attended court. According to Maina, the decision for him to stay away was also influenced by security concerns and surrounding speculation about the judgment.

Maina described Gachagua as committed to peace and said he had urged his supporters to remain calm following the ruling, while confirming that the legal battle would continue in the Court of Appeal.
