Freedom for Babu Owino as DPP Drops Case Against Him & Co-Accused

The DPP has withdrawn a criminal case against Babu Owino and six others in a Nairobi court.

This decision follows a high court ruling that deemed the charge of subversion unconstitutional.

Magistrate Onyina confirmed the termination of the case, citing the prosecution’s application. Babu Owino and his co-accused were initially charged in 2023 with conspiracy to commit subversive activities during nationwide protests endorsed by the Azimio la Umoja coalition.

Now free, Babu Owino intends to seek compensation through a constitutional petition for what he claims was unjust treatment, including lack of basic necessities and legal representation.

His lawyers emphasized the importance of respecting freedom of speech and association, as outlined in Article 37 of the constitution, during a media briefing following the court ruling.
