Kakamega Senator Boni Khalwale has taken legal action against businessman Cleophas Shimanyula, also known as Toto, for alleging that he was involved in the murder of his long-time employee, Kizito Moi Amukune. Amukune was discovered dead in a cow shed on January 28, with a postmortem revealing fatal injuries caused by a bull.
In his petition filed at the High Court in Nairobi, Khalwale accuses Shimanyula of making defamatory statements accusing him of murdering Amukune, despite medical evidence indicating otherwise.
Khalwale seeks a permanent injunction against Shimanyula from further disseminating the defamatory remarks and demands damages of Sh200 million, along with a public apology.
Through his lawyer Dunstan Omari, Khalwale asserts that Shimanyula’s accusations have tarnished his reputation, portrayed him as violent, and caused distress to his family.
He also claims that the businessman’s actions have interfered with investigations and portrayed him as corrupt.
Khalwale, who is a farmer and active in bullfighting, highlights Amukune’s loyal service as his employee for two decades, emphasizing the dedication shown to caring for a bull named Inasio, used in the sport of bullfighting.
