A group of boda boda operators has filed a lawsuit against the Kenya Kwanza government, claiming exclusion from government initiatives. Court documents reveal that the boda boda riders argue that the Kenya Kwanza campaign leading up to the 2022 General Election focused on empowering individuals involved in the boda boda and Mama Mboga businesses.
The riders assert that the Kenya Kwanza government has subsequently propagated a false narrative, suggesting that the current political administration is predominantly comprised of boda boda and Mama Mboga individuals. They argue that this portrayal has led to significant financial losses and irreparable harm to their businesses.
The petition, submitted by Malindi boda boda operators, including Linda Jamii and others, contends that the Kenya Kwanza slogan has adversely affected the income of boda boda and Mama Mboga entrepreneurs due to public dissatisfaction with the government.
Moreover, the court documents state that the utterances of the political party members have subjected those engaged in boda boda and Mama Mboga businesses to psychological trauma, stemming from a reduction in their income and hostility from dissatisfied Kenyans regarding the government’s failure to address the rising cost of living.
The petitioners are seeking a court order to prohibit the government from using the Mama Mbona and Bodaboda slogan, asserting that it threatens to violate their rights and fundamental freedoms. They claim that the use of the term by Kenya Kwanza has led to a 32% depreciation in the earnings of those in the boda boda sector, amounting to approximately Ksh. 426 billion.
