The Milimani High Court is set to review updates in the case surrounding the cancelled Adani Group concession deal for Jomo Kenyatta International Airport (JKIA).

This follows a petition filed by Tony Gachoka and the Mount Kenya Jurists, who are urging the government to present official proof that the agreement was indeed terminated.
Although President William Ruto previously directed the cancellation of the proposed Adani takeover of JKIA, the petitioners argue that formal evidence must be provided to confirm the deal’s nullification. They also contest the constitutionality of provisions in the Public-Private Partnership (PPP) Act, which formed the legal basis of the deal.
Ezra Makori, legal counsel for the Adani Group, told the court that the company no longer wishes to participate in the proceedings, citing the project’s cancellation.
Justice Bahati Mwamuye had earlier ordered the State to submit documents verifying the deal’s termination. However, a scheduled court session earlier this year was postponed due to incomplete submissions and procedural delays.

The upcoming mention will examine whether the State has complied with the court’s November 2024 directive requiring documentary proof of the concession’s cancellation.
Depending on the submissions, the case may proceed to a full hearing or receive further court directions.
