Two activists have petitioned the court to revoke Makau Mutua’s appointment as President William Ruto’s Senior Advisor on Constitutional Affairs.

Dr. Benjamin Magare and Eliud Matindi argue that the advisory role does not exist in the Constitution or any national legislation, rendering the position illegitimate.
The petitioners are also seeking an order compelling Mutua to refund any public funds he has received in connection with the appointment.
They claim that the position was filled without a transparent, competitive, or merit-based process, which they say violates constitutional principles.
“The President’s decision to appoint the second respondent is unconstitutional and therefore null and void,” the petition states.
