Gachagua Confident Courts Will Reverse Ouster

Former Deputy President Rigathi Gachagua has expressed renewed confidence in the judicial system, stating that he trusts the courts will ultimately deliver justice in his contested removal from office.

This comes after the Court of Appeal overturned a ruling made by Deputy Chief Justice Philomena Mwilu on October 18, 2024, which had allowed the formation of a three-judge bench to hear a petition challenging his ouster.

The appellate judges clarified that only the Chief Justice has the legal authority to empanel such a bench, and directed that the matter be referred back to her for proper handling.

Speaking during a church service in Juja, Kiambu County, Gachagua said the Constitution offers multiple avenues for legal redress through the hierarchy of courts—from the Magistrate’s Court to the Supreme Court.

He stressed that justice would eventually prevail not only for him but also for the people of Kenya.

“Our Constitution provides four levels of courts so that if you are denied justice at one stage, you can find it in the next,” he said. “There are judges of integrity who will ensure fairness.”

Gachagua also reaffirmed his political intentions, revealing plans to launch a new political party aimed at unseating President William Ruto in the 2027 General Election.

He claimed the new alliance would include key political figures such as former Interior CS Fred Matiang’i, Kalonzo Musyoka, Martha Karua, and Eugene Wamalwa.

“We are coming together. I, Kalonzo, Karua, Matiang’i, and Wamalwa will unite behind one candidate. They hope we will fall out, but with your prayers, we will remain united to rescue this country,” he stated.

He has also previously alluded to working with former Agriculture CS Mithika Linturi, ex-Public Service CS Justin Muturi, and former Trade Minister Mukhisa Kituyi.

The appellate ruling now raises legal questions surrounding both Gachagua’s removal and the appointment of his reported successor, Interior CS Kithure Kindiki.
