Matatu Operators Win Court Battle Against NTSA, Police

The High Court has instructed the Director General of the National Transport and Safety Authority (NTSA) and the Traffic Commandant to return the vehicle registration number plates that were unlawfully seized from matatu operators.

Justice Bahati Mwamuye ruled that NTSA’s decision to remove the number plates from the operators was unconstitutional.

The judge highlighted that a constitutional petition filed by 14 matatu operators raised significant concerns, and the court agreed that the requested orders should be immediately implemented.

The petitioners, represented by lawyers Danstan Omari and Shadrack Wambui, claimed that numerous matatus had been unlawfully impounded and their number plates taken by NTSA and traffic police officers.

The judge ordered that the impounded vehicles be released to their rightful owners without delay.

The lawyers argued that the actions of NTSA and traffic police had severely impacted the matatu industry.

The court directed that the order be served to NTSA and the traffic police, with the case set to be revisited on February 25 to ensure compliance.

Matatu operators gathered at Milimani Law Courts, sharing their struggles with journalists regarding the challenges they face in their daily operations.
