The High Court has ruled that the Kenyatta International Convention Centre (KICC) is owned by the Government of Kenya, rejecting a petition from the Kenya African National Union (KANU) party asserting ownership.
Judge Jackline Mogenyi, in a ruling on Monday, stated that the commissioner of lands in 1989 lacked the authority to transfer the land to KANU.
“The property, as registered in the name of the Permanent Secretary under the Ministry of Tourism, is deemed appropriate,” the court ruled.
The court, while nullifying KANU’s title deed, highlighted that the allocation to KANU was done unlawfully and against the constitution.
“The Ministry of Tourism is declared the rightful owner of the land, and KANU’s registration is deemed unlawful, illegal, and unconstitutional,” the court declared.
KANU has long asserted ownership of the property, even listing it among its assets in submissions to the Registrar of Political Parties. Previously, KICC was believed to be owned by KANU until the government under President Mwai Kibaki assumed control in 2003. Presently, the property is slated for privatization along with others.
