High Court Orders Immediate Release of Six Abducted Individuals

The High Court has directed the immediate release of six individuals who were allegedly abducted.

The individuals are Peter Muteti, Bernard Kavuli, Billy Mwangi, Gideon Kibet, Rony Kiplangat, and Steve Kavingo.

Justice Bahati Mwamunye also ordered that Inspector General of Police, Douglas Kanja Kirocho, ensure the six individuals are produced in court on Tuesday, December 31.

Kanja is required to personally ensure compliance with the Court’s order, both in his official capacity as IG and individually.

The Court has warned that any failure to comply with the directive will result in penalties for contempt of court.

“The 9th Respondent, Douglas Kanja Kirocho, shall, in his role as the 1st and 9th Respondent, personally ensure compliance with Orders (1) and (2), and produce the 2nd to 7th Petitioners/Applicants before this Court or the Milimani High Court Criminal Duty Court on 31/12/2024 at 11:00 AM in open court. A summons to that effect is hereby issued,” the judge stated.

Additionally, the Court issued a conservatory order preventing the respondents from arresting, detaining, or prosecuting the abducted individuals for any criminal offenses unless authorized by the High Court.

Justice Bahati further ordered that the Director-General of the National Transport and Safety Authority (NTSA), George Njao, or a designated officer, must appear before the Court on January 3, 2025, to present specific vehicle records relevant to the case.

Commenting on the ruling, Faith Odhiambo of the Law Society of Kenya (LSK) expressed readiness to take legal action for contempt if the IG or his officers fail to comply with the order.

“We are fully committed to ensuring these orders are enforced, and will pursue all necessary legal actions should they be ignored,” Odhiambo said.
