In the ongoing legal battle, the High Court has granted a temporary injunction prohibiting businessman Cleophas Shimanyula from making defamatory statements concerning Kakamega Senator Boni Khalwale and his family. These statements were related to the death of Shimanyula’s employee, Kizito Moi Amukune.
Lady Justice Janet Mulwa has also decided to transfer the case to the Kakamega High Court due to its relevance to events that occurred within Kakamega County.
“The plaintiff, being the Senator of Kakamega, and in the interest of justice and territorial jurisdiction of the court, I find it appropriate to transfer this case for adjudication at the High Court in Kakamega,” stated the Judge.
The matter has been scheduled for a hearing on March 19.
Khalwale initiated the lawsuit at the Milimani Law Courts after his demands, including an unconditional apology, were ignored by Shimanyula.
Represented by his lawyer, Danstan Omari, Khalwale informed the court of the defamatory comments made against him by Shimanyula in recent weeks. These remarks allegedly linked Khalwale to the death of Shimanyula’s former employee.
“Despite repeated requests for retraction and an unconditional apology, Shimanyula has failed to comply and has instead continued to make defamatory statements, leading to the necessity for legal action,” stated court documents submitted by Khalwale.
Khalwale emphasized the emotional distress caused by these remarks and their potential to subject him and his family to public ridicule.
The deceased, Kizito, was found dead in the stable of a bull he had tended to for over 20 years, with multiple injuries believed to be inflicted by the animal.
