A three-judge bench is expected to issue crucial directions today in the ongoing legal challenges to the impeachment of Deputy President Rigathi Gachagua.
The case, which has attracted significant attention, will see Justices Eric Ogola, Anthony Mrima, and Fredah Mugambi address over 30 petitions that have been filed in relation to the matter. The bench had previously stated that today’s proceedings would focus on allowing Gachagua to pursue an appeal challenging the appointment of the judges to hear and determine the cases.
At the center of the dispute is Gachagua’s challenge to the powers of Deputy Chief Justice (DCJ) Philomena Mwilu, who assigned the trio of judges to handle the impeachment cases. Gachagua’s legal team is questioning whether DCJ Mwilu had the authority to make such an appointment.
Today’s session is expected to provide clarity on the procedural aspects of the case and potentially shape the course of the legal battles surrounding the impeachment proceedings.
