Court Grants Wambui Nyutu Temporary Relief from NCIC Removal

Wambui Nyutu has been granted temporary protection by the High Court, allowing her to remain in her role as Vice Chairperson of the National Cohesion and Integration Commission (NCIC) while legal proceedings challenging efforts to remove her continue.

On August 6, 2025, Justice Bahati Mwamuye issued interim conservatory orders preventing any attempts to oust her from office until a final decision is made on her petition contesting the removal process.

Nyutu argues that the push to remove her is unlawful and premature. Her lawyers maintained that while no official action has been taken yet, the threat of removal is still present, as any party—not just the respondents—could initiate such a move.

Justice Mwamuye questioned whether the threat was real or speculative, but ultimately decided to issue the temporary orders, stating:

“Pending delivery of judgment in this matter, conservatory orders be and are hereby issued restraining the first respondent from furthering any motion or action for the removal of the petitioner from the office as the commissioner of the first respondent.”

However, the court emphasized that these orders are conditional. They will automatically expire if Nyutu fails to meet specific procedural requirements, including the timely filing and serving of legal documents.

The next court date, for the highlighting of submissions, has been scheduled for September 11, 2025.

For now, the court’s decision secures Nyutu’s position at the NCIC unless or until a different ruling is made.
