Third Attempt to Halt Gachagua Impeachment Fails

A third attempt to halt the impeachment motion against Deputy President Rigathi Gachagua has failed, as a three-judge bench in the High Court’s Constitutional Division declined to issue interim orders.

This follows the unsuccessful efforts of former United Democratic Alliance (UDA) Secretary-General Cleophas Malalah and the civil society group Sheria Mtaani.

The petition, filed by Caroline Wambui Mwangi against the Senate and National Assembly, aims to stop the impeachment process.

Justice Lawrence Mugambi ordered that the application and petition be served by the end of the business day.

“Responses to the Petition and Application must be filed and served within five days. Any rejoinders, if necessary, should be filed within three days,” the court documents stated.

The case is scheduled for mention on October 9, 2024, for further directions.

Gachagua faces accusations of violating Article 10 concerning National Values and Principles of Governance due to his allegedly inciteful, reckless, and inflammatory public statements that could incite ethnic hatred and division.

Additionally, he is accused of violating Articles 147, 148, 174, 186, and 189, which relate to his conduct and responsibilities as the President’s principal assistant.

Furthermore, the Deputy President is alleged to have corruptly and unlawfully acquired assets using taxpayer funds.
