Former Migori Governor Okoth Obado will be required to present a defense in the murder case of Rongo University student Sharon Otieno.
Obado’s personal assistant, Michael Oyamo, and former county employee Caspal Obiero have also been ordered to defend themselves.
Justice Cecilia Githua determined that the prosecution’s evidence established a prima facie case, justifying the three individuals being put on their defense.
However, the three were acquitted of charges related to the death of Sharon’s baby.
At the time of Sharon’s death, her fetus was 28 weeks old.
The judge agreed with the defense’s argument based on the “born alive” principle, which asserts that for a child to be considered a murder victim, the child must have been born alive.
“I have considered these submissions and I agree that the prosecution’s evidence does not support the charge of murder concerning baby Sharon,” the judge stated.
