The board’s decision, made by chairman Adrian Kamotho, temporarily stayed the NTSA’s suspension, which was originally enacted on March 18, 2025. The order stated, “An interim order is hereby issued staying the execution/enforcement/operation of the decision of the respondents dated March 18, 2025, suspending the operation of the appellant herein Super Metro Sacco Limited as a PSV operator,” and further clarified, “The appellant is at liberty to immediately resume operations in due compliance with the law.”
The NTSA was named as the respondent in the case. Kamotho also directed that the document be served to the Inspector General of Police without delay.
The suspension, which took effect on March 20, 2025, was imposed by the NTSA due to concerns regarding Super Metro’s compliance with road safety regulations. The NTSA’s decision came after the company was found to have violated several safety measures.
In its statement, the NTSA explained that the suspension was necessary to ensure the company adhered to the Public Service Vehicle (PSV) Regulations of 2014 and implemented proper safety measures to safeguard passengers and other road users. Alleged violations included expired inspection certificates, expired speed limiter certificates, missing vendor details, and inadequate driver qualifications.
Additionally, the NTSA outlined the conditions Super Metro must meet to have its license reinstated. These included presenting 294 vehicles for inspection and submitting 42 drivers for a retest due to previous speed violations. The authority also noted that 64 drivers had failed a retest on March 10, 2025, which led to the suspension of their driving licenses.
Following the court’s order, Super Metro presented its fleet for inspection at the Likoni Motor Vehicle Inspection Centre in Nairobi on Saturday morning.
