Nairobi Court Directs Blogger to Delete Posts Defaming Hospital Founder

A Nairobi court has instructed blogger Edgar Obare to remove social media posts concerning Dr. Sam Thenya, the founder of Nairobi Women’s Hospital.

The court determined that the posts, shared on platforms like Instagram, Facebook, and Telegram, were defamatory.

Magistrate Becky Cheloti Mulema issued the order after concluding that the posts seriously harmed Dr. Thenya’s reputation, character, and integrity. The decision followed evidence presented by Thenya’s lawyer, Cecil Miller, who demonstrated that the content was damaging.

“I have reviewed the affidavit dated September 6, 2024, and find sufficient grounds to grant the request to take down the posts shared across the three platforms,” Mulema stated.

The magistrate also pointed out that Obare failed to provide a reasonable explanation for publishing the material or for refusing to delete it. She added, “Without a valid reason for the publication of the defamatory content, there is no justification to deny the request for its removal.”
