The Kenya Airports Authority (KAA) has been instructed by the court to pay Sh84 million for appropriating a 1.2-acre plot of land adjacent to Moi International Airport, Mombasa, which it unlawfully fenced off.
Judge Nelly Awori Matheka of the Environment and Land Court deemed KAA’s compulsory acquisition of the land belonging to Abeid Awadh and Omar Khamis as unconstitutional and a breach of their property rights.
Matheka highlighted evidence indicating KAA’s awareness of the land’s ownership dating back to 1978, and criticized KAA’s failure to adequately address the situation despite being notified multiple times.
The court affirmed that KAA’s encroachment on the land without proper compensation infringed upon the owners’ property rights.
