Impeached DP Rigathi Gachagua Appeals High Court Ruling

Impeached Deputy President Rigathi Gachagua has filed an appeal challenging last week’s ruling by a three-judge bench, expressing dissatisfaction with the decision.

 

Gachagua argues that the ruling, which upheld the Deputy Chief Justice’s authority to constitute the bench, was erroneous and based on a flawed interpretation of the Constitution.

 

In his appeal, Gachagua seeks to have the Court of Appeal issue a stay on the High Court proceedings pending the hearing and determination of his application.

He contends that without this stay, the bench may continue to hear and rule on interlocutory applications and petitions in a manner that he claims would violate the Constitution.

 

Through his legal team, Gachagua also criticized the bench for refusing to extend interim conservatory orders that were previously in his favor, despite his efforts to have them prolonged.

 

In his application, Gachagua stated that the actions and omissions of the bench were not only unlawful but also incorrect and procedurally flawed.
