Court Stops Nairobi Hospital AGM After Omtatah Petition

The High Court has suspended the planned annual general meeting of the Kenya Hospital Association (KHA), the body that owns Nairobi Hospital, following a petition filed by Busia Senator Okiya Omtatah.

In a ruling delivered on Thursday, the court issued a conservatory order blocking the AGM amid an ongoing legal dispute over the hospital’s leadership and governance.

Milimani Law Courts judge Lawrence Mugambi granted the orders after considering an urgent application by Omtatah, whose supporting affidavit was sworn on February 3. The petition sought to stop the AGM that had been scheduled for Friday, February 6.

In the order, the court barred the first and second respondents, as well as their agents, employees, servants and proxies, from convening, conducting or proceeding with the Kenya Hospital Association’s AGM, including any adjourned meetings.

Justice Mugambi further directed that the petition and application be served on the respondents in both physical and electronic form within three days. The respondents were given seven days from the date of service to file their responses.

The court warned that failure to comply with the order would attract penal consequences against those involved.

The conservatory order will remain in effect until further directions are issued, with the matter scheduled for mention on February 23.

The decision marks the latest twist in long-running leadership wrangles at Nairobi Hospital. In recent years, the Kenya Hospital Association has been plagued by internal disputes between its board and sections of its membership.

The conflicts have largely revolved around allegations of mismanagement, director election procedures and disagreements over the hospital’s strategic direction.

In his petition, Omtatah raises concerns over governance failures and alleged financial irregularities at the facility, including claims that Sh9 billion cannot be properly accounted for.
