The High Court in Kericho has reduced the damage fee imposed on parents of Litein Boys’ High School students from Sh49,000 to Sh10,000 each, following a recent student strike at the school.
Justice Joseph Sergon, in his ruling, termed the initial amount “unreasonable, punitive, and insensitive” given the current economic hardships faced by many families. He directed that each parent pay Sh10,000 instead, calling the decision more fair and considerate.

The dispute stemmed from a student unrest on September 21, triggered after learners were denied permission to watch an English Premier League match between Arsenal and Manchester City. During the chaos, several buildings and vehicles were damaged.
The school administration had initially demanded Sh49,000 per student to cover repair costs, later revising the figure to Sh25,000 after complaints — a move parents still considered excessive. They moved to court, arguing that the directive was unfair and lacked transparency in how the damage costs were assessed.

Lawyer Danstan Omari, representing the parents, told the court the fee was oppressive and risked locking out over 2,500 students from continuing their education. The parents also urged the Teachers Service Commission (TSC) to probe repeated unrests and management issues at the school.
Justice Sergon ordered both parties to file their final submissions by November 21 for the court’s final determination.
Parents welcomed the interim judgment, saying it highlighted the need for dialogue, fairness, and student engagement before imposing financial penalties on families.
